California Proposition 65 Scientific Expertise
Dr. Paul Rosenfeld has extensive experience evaluating exposures and human health risks under California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). Throughout his career, he has assessed whether consumer products, building materials, industrial operations, and environmental releases may result in exposures to Proposition 65-listed carcinogens and reproductive toxicants. His work has involved evaluating exposure pathways, reviewing toxicological and epidemiological literature, reconstructing historical exposures, and determining whether estimated exposures exceed established No Significant Risk Levels (NSRLs) or Maximum Allowable Dose Levels (MADLs) published by the California Office of Environmental Health Hazard Assessment (OEHHA). Dr. Rosenfeld has also been retained in Proposition 65 litigation involving consumer products and has prepared expert reports, rebuttal opinions, declarations, and deposition testimony concerning the scientific basis of Proposition 65 exposure assessments and regulatory requirements.
Exposure Assessment and Proposition 65 Risk Evaluation
RoseyFields applies the same scientifically accepted exposure assessment methodologies used by OEHHA, the U.S. EPA, and the industrial hygiene community when evaluating Proposition 65 issues. These evaluations include estimating inhalation, dermal, incidental ingestion, and consumer product exposures using accepted exposure factors, published emission data, analytical testing results, environmental measurements, and product use scenarios. Exposure estimates are then compared to OEHHA’s published NSRLs and MADLs using conservative assumptions that are protective of public health. Where necessary, RoseyFields performs chemical-specific fate and transport evaluations, air dispersion modeling, historical exposure reconstruction, industrial hygiene assessments, and quantitative cancer and non-cancer risk assessments to determine whether exposures are likely to require a Proposition 65 warning or whether available scientific evidence supports an alternative conclusion.
Comprehensive Proposition 65 Litigation Support
RoseyFields has experience supporting attorneys, manufacturers, retailers, consultants, and expert witnesses in complex Proposition 65 matters involving chemicals listed as carcinogens and reproductive toxicants. This work includes reviewing OEHHA regulations, Safe Use Determinations, warning requirements, exposure assessments, toxicological studies, industrial hygiene data, analytical chemistry, and scientific literature relevant to Proposition 65-listed chemicals. Our experience extends to evaluating competing expert opinions, identifying strengths and weaknesses in exposure methodologies, preparing scientifically defensible rebuttal reports, and explaining complex exposure science in a manner understandable to courts, regulatory agencies, and juries. This combination of industrial hygiene, exposure science, toxicology, risk assessment, and litigation experience allows RoseyFields to provide comprehensive scientific support in Proposition 65 matters from the initial technical evaluation through deposition and trial.
